Standard Terms and Conditions

Payment

The Client shall pay the agreed fee as soon as possible on receipt of the Illustrator’s invoice.

Cancellation

If the Client decides to cancel the commission, and the agreement has been signed, then the Client shall pay a cancellation fee.

If the commission is cancelled then ownership of all rights shall revert to the Illustrator.

Delivery

The Illustrator however will not be held liable for any consequential loss or damages arising from late delivery of artwork.

Rejection of Artwork

If the Client finds the artwork unsatisfactory and rejects the artwork then the Client shall pay a rejection fee.

The Client must make immediate objection to the artwork, and will inform the Illustrator within 7 days of delivery. If the artwork is rejected then ownership of all rights shall revert to the Illustrator.

Changes

If the Illustrator is required to make major changes, additions or variations to the original work through the brief being changed by the Client then the Illustrator may require an additional fee.

Warranties

The Illustrator warrants that the artwork is original and does not breach anyone else's copyright.

The Client warrants that any reference materials or visuals supplied by the Client do not breach anyone else's copyright.

Moral Rights

The Illustrator’s artwork will not be intentionally altered, damaged or destroyed without the consent of the Illustrator. This includes adapting artwork physically or electronically

Publicity

The Client gives the Illustrator permission to state that the Client has previously commissioned her to do work for them.

The Client will also allow the Illustrator to use examples of the work done for them in publicity brochures/leaflets/newsletters and on a section of her website.

Completeness

The Client agrees that this contract contains the whole agreement between the Client and the Illustrator and supersedes all prior agreements, representations and understandings (written and verbal) between the Client and the Illustrator.
